Governing Law

These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Republic of India, without giving effect to any conflict of law provisions.

Jurisdiction

Subject to the dispute resolution clause below, any legal proceedings arising out of or in relation to these terms shall be subject to the exclusive jurisdiction of the courts located in Uttarakhand, India. By using our services, you irrevocably consent to this jurisdiction.

Dispute Resolution

Step 1 — Contact Support: We strongly encourage you to contact our customer support team first. Most disputes are resolved quickly and informally.

Step 2 — Mediation: If informal resolution fails, either party may request mediation through a mutually agreed mediator.

Step 3 — Arbitration: Unresolved disputes shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India). The seat of arbitration shall be Kashipur, Uttarakhand.

Step 4 — Courts: If arbitration is not applicable or fails, the matter may be escalated to the courts of Uttarakhand.

Class Action Waiver

All disputes must be brought on an individual basis. You waive any right to participate in class-action lawsuits or class-wide arbitration against Sooper Buddy.
